Event Terms & Conditions

PARTICIPANT TERMS AND CONDITIONS
These Conditions apply to your participation in the Event.  Please read these Conditions carefully before submitting a Registration Form.  If you do not accept these Conditions, you should not submit a Registration Form.

1	Your contract.
1.1	Only when: (i) you have submitted a Registration Form and paid your Registration Fee; and (ii) we have issued to you your Booking Confirmation will a contract be created between you and us governing your participation in the Event and our provision of the Event.  
1.2	Once we have received your Registration Form (including medical disclaimer), Registration Fee and, where relevant, the Event Logistics Supplier has reviewed and approved your medical questionnaire, we will confirm your place on the event with a Booking Confirmation. If we cannot provide you with a Booking Confirmation, we will notify you by e-mail.
1.3	You should check your Booking Confirmation carefully as soon as you receive it. You must contact us (or, in respect of the medical questionnaire, the Event Logistics Supplier) immediately if any information in the Booking Confirmation appears to be incorrect or incomplete as it may not be possible to make changes later.
1.4	Your contract for the Event is with us.  We contract with the Event Logistics Supplier to deliver the Event for you.  The contract between you and us consists of your Registration Form, our Booking Confirmation, these Conditions and our Privacy Policy. 
1.5	If you have questions regarding these Conditions or otherwise relating to your participation in the Event, please contact us at: events@alzheimers.org.uk .

2	Terms used in these Conditions.
Certain terms when used in these Conditions have a particular meaning.  This section sets out what those terms are and what they mean when they are used in these Conditions. 
'Booking Confirmation': our written acknowledgement, sent via email, confirming that you have been accepted as a participant in the Event.
'Conditions': these Trek26 Participant Terms and Conditions.
'Data Protection Laws': (1) Data Protection Act 2018; (2) UK GDPR; (3) Privacy and Electronic Communications Regulations 2003; and (4) all other applicable laws and regulations relating to the processing of personal data and privacy in force in the UK as amended, extended or replaced from time to time.
'Event': the Trek26 series event for which you have submitted a Registration Form.
'Event Date': the date on which the Event will take place as stated on your Registration Form. 
'Event Logistics Supplier': the supplier we have engaged to deliver the Event, being Gladiator Events Limited, company number 08810090 with its registered office at 7 Bell Yard, London, WC2A 2JR.
'Event Manager': our staff member who manages the Event, alongside the Event Logistics Supplier, who will be introduced to you on the Event Date.
'Minimum Sponsorship': the minimum amount (excluding your Registration Fee and the benefit to us of any gift aid) that you, by submitting a Registration Form, pledge to raise for and pay to us as stated on your Registration Form.
'Minimum Participant Number': that minimum number of participants required to be registered for the Event for that Event to proceed, which for this Event is 500.
'Privacy Policy': our privacy policy available at: https://www.alzheimers.org.uk/legal-information/privacy-security;
'Registration Fee': the fee payable by you on submission of your Registration Form as stated in on the Registration Form.
'Registration Form': the form completed by you and submitted to us confirming your registration as a participant in the Event.
'personal data', 'data subject', 'data processor', 'data controller' and 'process' each have the meanings given in the Data Protection Laws.
'UK GDPR' has the meaning given to it in section 3(10) (as supplemented by section 205(4)) of the Data Protection Act 2018.
'Unavoidable and Extraordinary Circumstance(s)' a situation which is beyond our control, the consequences of which could not have been avoided even if reasonable measures had been taken, including, for example, (whether actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire pandemic/epidemic, closure, restriction or congestion of public transport infrastructure.
'We', 'us' or 'our': means Alzheimer's Society, company number 2115499 and registered charity number 296645 with its registered office at 43-44 Crutched Friars, London, EC3N 2AE.
'You' or 'your': means you, the participant named in the Registration Form.

3	Requirements for confirmation as a participant in the Event.
3.1	To participate in the Event you must: (1) complete and submit a Registration Form (including medical disclaimer); (2) pay the Registration Fee; (3) be at least 18 years old on the Event Date (except as provided at Condition 3.2); (4) not have an alcohol or drug dependency; and (5) be fit enough to cover a tough day of trekking across challenging terrain. 
3.2	Young people (over 14 years old on the Event Date) may participate if accompanied at the Event by a parent or guardian (who must register as a separate participant for the Event).
3.3	If you are unable to submit a Registration Form because you are unable to agree to the medical disclaimer, you should contact us to request a medical questionnaire.  You will need to submit your completed medical questionnaire to the Event Logistics Supplier You may, in addition be required to provide a doctor's note to certify your fitness for your chosen Event.  Based on your responses to the medical questionnaire and, if relevant your doctor's note, we will determine and subsequently notify you whether or not you may continue to register as a participant in the Event. 
3.4	If you suffer from reduced mobility or have any other medical condition or disability which may affect your participation in the Event or any special requirements as a result of reduced mobility or any medical condition or disability, you must inform us before submitting your Registration Form and provide full details on your medical questionnaire so that the Event Logistics Supplier can assess and give appropriate advice as to the suitability of the Event given your circumstances. You must also promptly inform us or the Event Logistics Supplier if any change in the condition, disability or mobility occurs or if any medical condition, disability or reduction in your mobility which may affect your participation in the Event develops subsequent to submission of your Registration Form.

4	Fees and payments.
4.1	We require you to pay the Registration Fee on submission of your Registration Form.  If you do not pay the Registration Fee you will not be confirmed as a participant for the Event.  Except in the circumstances set out in Conditions 9.3 and 11.1, once we have issued a Booking Confirmation, your Registration Fee is not refundable.
4.2	When you submit a Registration Form you are agreeing to raise and to pay to us the Minimum Sponsorship.  You agree to pay to us the Minimum Sponsorship together with all other amounts raised by you as sponsorship for your participation in the Event not later than six (6) weeks after the Event Date.  All payments to us shall be made by you via debit or credit card, by cheque, direct bank transfer or via a secure online fundraising platform such as JustGiving.
4.3	Should you, for whatever reason, not take up your place at the Event, all sponsor forms and sponsor money collected must be forwarded to us or returned to sponsors if requested and if this is possible. 

5	Your privacy
5.1	By submitting your Registration Form you acknowledge and consent to us sharing any personal information you provide to us with the Event Logistics Supplier, to assist them with planning, operating and managing the Event on our behalf.  We might request additional personal information from you where necessary to ensure that the Event can be run efficiently, professionally and safely.  The Event Logistics Supplier will also share with us personal information you have provided to them where this is necessary to enable us to steward you through the Event.  
5.2 	In respect of the processing of your personal data, we and the Event Logistics Supplier are each a data controller for the purposes of the Data Protection Laws. We and the Event Logistics Supplier will each need to use, where appropriate disclose, and otherwise process the personal data you provide, in order to respond to an enquiry, send you any material relating to the Event, administer your booking and organise and provide the Event. 
5.3	Personal data which concerns your health or reveals your racial or ethnic origin are special categories of personal data. We and the Event Logistics Supplier require your consent to process special categories of personal data. 
5.4 	We will only process your personal data, in accordance with our Privacy Policy or as permitted by the Data Protection Laws. Please read the Privacy Policy for full details of the personal data we collect from you (either directly or through the Event Logistics Supplier), why we do so and what we do with this data. We will take appropriate technical and organisational measures to protect against unauthorised or unlawful processing of your personal data and against accidental loss or destruction of, or damage to, your personal data, as is appropriate to the harm that might result. Your personal data will be retained by us for the period referred to in our Privacy Policy or as otherwise permitted by the Data Protection Laws.
5.5 The Event Logistics Supplier will only process your personal data in accordance with its privacy policy (available at https://www.gladiatorevents.co.uk/privacy-policy). 
5.6 	You can ask us at any time what personal data of yours is being held or processed by us, for what purpose and to whom it may be or has been disclosed. You may also withdraw your consent to receiving marketing material or other communications from us (other than communications relating to the Event) at any time by unsubscribing to our e-mails or otherwise contacting us by e-mail at: Events@alzhemers.org.uk . Please also let us know if you believe the personal data we are holding is inaccurate, out of date or incomplete. If you have any complaint about the way in which your personal data has been dealt with, please contact us by e-mail at: Events@alzhemers.org.uk.  We will investigate and respond to you as soon as reasonably possible. If you remain dissatisfied, you may complain to the Information Commissioner's Office. For further details, see www.ico.org.uk . 
5.7	You agree that we may use, without payment, notice or further consent, any photographs, videos and other images in which you appear and which are taken at the Event or any Event-related occasion by our employees or suppliers or any participant or other person attending, in our printed materials, website, social network marketing activities or any other relevant promotional material. We will not, however, identify anyone by name without their agreement.  Should you prefer that we do not use any such images in which you may appear in any such media or materials or if you do not wish to be the subject of any photography, please notify us by telephone on 0300 222 5808 or by email at: Events@alzheimers.org.uk.

6	Your responsibilities
6.1	You must not do anything or fail to do anything which is reasonably likely to bring us into disrepute whether before during or after the Event.
6.2 	You must ensure that all information you provide to us or to the Event Logistics Supplier (including all information on the Registration Form, medical disclaimer and medical questionnaire, where applicable)) is complete, true and accurate. If you fail to do so in any material respect, we shall be entitled to cancel your booking and your Registration Fee will be retained by us. 
6.3	You must carry out your fundraising in accordance with guidelines provided by us. Where relevant, you must take all necessary steps to protect vulnerable people and other members of the public from unreasonable intrusions of privacy, unreasonably persistent approaches and undue pressure to donate.  You must provide us with such information as we request to monitor your compliance with this Condition.
6.4	You must follow any reasonable instructions that we and/or the Event Logistics Supplier may give you in relation to your participation in the Event, either in pre-event documentation or during the Event. You are responsible for your own actions or inactions. Where these differ from instructions given by us or the Event Logistics Supplier, neither we nor the Event Logistics Supplier, or our respective employees or agents can be held responsible for loss or damage to personal effects, injury or death.
6.5	You accept responsibility for any damage or loss you may cause. If in the course of your participation in the Event you cause loss or damage you must make full payment for such loss or damage (reasonably estimated if not precisely known) at the relevant time direct to the party suffering the loss or damage. If the actual cost exceeds the amount paid where estimated, you must pay the difference once known. You will be responsible for meeting any claims made against us and/or the Event Logistics Supplier (together with all legal costs) as a result of your actions in the event that you have failed to make payment in full.
6.6	If you are provided with any safety equipment for the purposes of the Event you must use such equipment correctly and as instructed, at all times. 
6.7	The Event is a walking event and participants must not run any part of the Event route.
6.8	Dogs are not permitted on the Event route except where we have provided our express consent in writing.

7	Risk and insurance
7.1	Participation in the Event is at your own risk. We do not arrange insurance for participants.
7.2 	The Event Logistics Supplier will provide advice, instructions and warnings to minimise risk and you will be required to comply with them. We require that you take a credit card with you on the Event to cover any unexpected costs and would recommend that you ensure you have sufficient available funds / credit limit.
7.3	The Event may involve hazards inherent to the activities involved in it. These hazards increase the risk to participants of personal injury, death, illness, and/or loss or damage to property. You acknowledge and accept the inherent hazards involved in the Event. Except as otherwise set out in these Conditions, we cannot accept any liability for any personal injury, death, illness, loss or damage to property or any other loss or damage you incur as a result your participation in the Event. 
7.4	If you take your own equipment on an Event you do so at your risk.  You are responsible for any charges for transportation and for any loss and/or damage to or caused by such equipment. 

8	Changes 
8.1	We or the Event Logistics Supplier may make changes to the Event or itinerary of the Event should this be necessary due to any Unavoidable and Extraordinary Circumstance(s).  We will notify you of any such changes as soon as practicable. The decision of the Event Logistics Supplier as to the Event and/or itinerary of the Event is final.
8.2	Should you wish to make any changes or have any special requests following submission of your Registration Form, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee that we will be able to accommodate your request(s) unless this is specifically confirmed to you in writing. An administration fee of £10 per change request per person will be payable by you.

9 	Our right to cancel the Event
9.1	If the Minimum Participant Number is not achieved, we may, in our sole discretion, cancel the Event.  If we decide to cancel the Event we will notify you.  We will not cancel the Event for this reason any later than 56 days prior to the Event Date.
9.2	We may cancel the Event if this is considered by us to be necessary due to any Unavoidable and Extraordinary Circumstance(s).
9.3	If we cancel the Event under Condition 9.1 or 9.2 you may be offered the choice of transferring your booking to an alternative Trek26 series event.  If you accept an offer to transfer to another event, you may be required to pay the Registration Fee for that event.  If no transfer is offered or you refuse to transfer, you will be entitled to a complete refund of the payments you have made to us for the Event. No compensation or other sums will be payable in addition (including, for example, in respect of any accommodation or travel costs you may have incurred). 
9.4	Any sponsor money you have collected must be paid to us and this will be treated as a donation (unless sponsors have specifically provided that their sponsorship should be returned to them). We are unable to return donations that have been made anonymously or any income raised through fundraising events.  

10 	Your rights to end your participation in the Event
10.1	You may cancel your participation in the Event at any time. If you wish to cancel, we must receive notice in writing from you. The effective date of cancellation will be the date such notice is received by us. Your Registration Fee is not refundable in the event of cancellation by you. 
10.2	If you cancel we may, at our discretion, offer you the opportunity to participate in an alternative Trek26 series event taking place within three months of your Event Date.  
10.3	If you accept an offer to transfer to an alternative event you will need to pay the registration fee for that event but your sponsorship can be carried forward to the new event.
10.4	If you do not accept an offer to transfer to an alternative event, any sponsor money you have collected must be forwarded to us and this will be treated as a donation (unless sponsors have specifically provided that their sponsorship should be returned to them). We are unable to return donations that have been made anonymously or any income raised through fundraising events. 
10.5	It is your responsibility to contact your sponsors telling them you are no longer participating in the Event, and what will happen to their sponsor money.

11 	Our rights to end your participation in the Event
11.1	We and the Event Logistics Supplier shall be entitled on reasonable grounds to refuse or terminate your participation in the Event at any time without having to disclose the reason. Your entitlement to participate depends on our being satisfied that there are no circumstances under which we or the Event Logistics Supplier ought properly to decline or terminate your participation. Our decision and the decision of the Event Logistics Supplier on your participation in the Event shall be final and binding. In any circumstances where we or the Event Logistics Supplier decides that you may not participate, your Registration Fee will be refunded to you in full. 
11.2	 If in the opinion of the Event Logistics Supplier, its employees or agents, your behaviour or physical condition is or is likely to be detrimental to your safety, welfare and well-being or that of other participants or staff, you may be required to leave the Event without the right to any refund.
11.3	We want you to complete the Event and will endeavour to ensure that you can.  However, this may not always be possible, and you may be prevented from participating or be required to leave the Event early for reasons such as ill-health, fitness, injury etc. You may also be required to end your participation in the Event if you have failed to arrive at a checkpoint before the pre-agreed cut off time confirmed by the Event Logistics Supplier.  In any of the foregoing circumstances, we will not provide a refund of the Registration Fee or any other costs incurred by you. 
11.4	Where, under this Condition 11, your participation in the Event is terminated and you are an adult accompanying a participant in the Event who is under the age of 18, the participation of the participant under the age of 18 will also be terminated.  If you are a participant in the Event who is under the age of 18 and the participation in the Event of the adult accompanying you is terminated, your participation in the Event will also be terminated.

12	Our liability to you if things go wrong
12.1 We will use our reasonable efforts to ensure that the Event goes ahead as planned and that the Event is delivered and performed with reasonable skill and care. This means that, subject to these Conditions, we will accept responsibility to you if, for example, you suffer death or personal injury or your contracted Event arrangements are not provided as promised or prove deficient as a result of any failure by us, our employees, agents or suppliers to use reasonable skill and care in delivering or performing your contracted Event arrangements. 
12.2	It is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (in the case of employees) or carrying out work we have engaged them to do (in the case of agents and suppliers). 
12.3 We will not be responsible for any injury, illness, death, loss (including loss of enjoyment or possessions), damage, expense, cost or other sum or claim of any description whatsoever if and to the extent it results from: (1) the act(s) and/or omission(s) of the person(s) affected; (2) the act(s) and/or omission(s) of any third party not connected with the provision of the Event; or (3) any Unavoidable and Extraordinary Circumstance.
12.4 We do not accept responsibility for any services which do not form part of our contract with you. This includes, for example, any additional services or facilities which any other supplier agrees to provide for you where we have not contractually agreed to provide or arrange such services or facilities. 
12.5 We do not exclude or limit our liability to you in respect of personal injury or death which we or our employees have caused to you intentionally or negligently. For all other claims, if we are found liable to you on any basis, the maximum amount we will have to pay to you will be three times the Minimum Sponsorship.
12.6 We do not accept any liability for any damage, loss, expense or other sum(s) of any description: (1) which on the basis of the information given to us by you on submission of your Registration Form, we could not have foreseen you would suffer or incur if we breached our contract with you; or (2) which did not result from any breach of contract or other fault by us or our employees or, where we are responsible for them, our suppliers. Additionally, we cannot accept liability for any business expenses or losses including, for example, self-employed loss of earnings. 

13	Other services
Many of the services which make up the Event are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you. Copies of the relevant parts of these terms and conditions are available on request from the supplier concerned.

14	Complaints
If you have a complaint about any aspect of the Event, you must tell the Event Manager and Event Logistics Supplier at the time. It is only if the Event Manager and the Event Logistics Supplier know about problems that there will be the opportunity to put things right. Any unresolved complaints must be communicated to us in writing as soon as possible and no later than 28 days after the end of the Event. 

15	Law
You and we agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between you and us. You and we also agree that any claim (including any involving personal injury) must be dealt with by the courts of England and Wales.
